I have found a couple of threads with people asking about the legal status in certain states. Here is a great wiki-site that seems fairly up-to-date with the legal status in states and countries.

The whole situation with it certainly makes me frustrated/angry.
Off to go see what I can do about the current pending bill in my state...

They tried to make it a felony in Florida but it may have fizzled out. I never heard any more about it.
